Cheqr Payment Solutions LLC respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you access or use CheqrPay™.

This policy also describes your rights regarding our privacy practices.

By checking the box to indicate acceptance, or by accessing or using CheqrPay, you accept and agree to the terms and conditions of this Privacy Policy. If you do not agree, do not access or use CheqrPay.

We may update our Privacy Policy from time to time. If we make material changes in how we treat the personal information of our users, we will post the new Privacy Policy on this page. Although we may notify you by email or an in-app alert the first time you use CheqrPay after such changes, you are responsible for periodically visiting this page to check for changes to our Privacy Policy. Your continued use of CheqrPay after we make changes constitutes your acceptance of those changes.

CheqrPay is not designed for use by children. We do not knowingly collect personal information from children under age 16..

 

1. Information We Collect

 “Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could be reasonably linked, directly or indirectly with a particular consumer or household.

The types of personal information that we collect about you may include:

  • Personal details, such as your name, physical location, login credentials, and transactions that you initiate using CheqrPay;
  • Contact information, such as your email address, telephone and facsimile numbers, residential, business, and postal addresses, and other contact information;
  • Statistical information about your interactions with CheqrPay and your online habits, such as traffic, location, and communication data; and
  • Technical information about the device you use to access CheqrPay and your internet connection, including the device’s unique identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.

 

2. Third Party Payment Processor

We use Stripe, a third-party payment processor, for all payments that you make through CheqrPay. Although CheqrPay receives certain information from you to initiate payments and manage transactions, CheqrPay does not receive your financial information, such as bank account or credit card details. Stripe receives your financial information directly and processes the payment. CheqrPay has no access to or control over the funds used for payment.

3. How We Collect Information

We collect personal information about you from your use of CheqrPay. We also may collect your personal information when you contact or otherwise interact with us. The technologies used to collect information from you may include:

  • Cookies (or mobile cookies).
    A cookie is a small file placed on your smartphone or other device.
    Cookies enable us to remember information about your preferences and to improve CheqrPay and the experiences of our users. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting, you may be unable to access certain features or functions of CheqrPay.
  • Web Beacons.
    CheqrPay and emails from us may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs). The web beacons provide us with information, such as the number of users who have accessed CheqrPay, opened an email from us, and other application-related statistics (for example, recording the popularity of certain application content and verifying system and server integrity).

 

4. How We Use Your Information

We do not sell your personal information.

We collect, store, and use personal information to enable us to operate our business, including:

  • developing and communicating our marketing and promotions to our current and prospective customers;
  • developing and improving our products, customer service, and relationships;
  • investigating any complaints from our users or if we have reason to suspect that a user is in breach of any of our terms and conditions governing access to or the use of CheqrPay; and
  • as required by law.


We also collect, hold, use, or disclose the personal information that you provide to us:

  • to verify your identity; and
  • to communicate with you about your use of CheqrPay or to respond to your inquiries or complaints.

 

We rely upon our legitimate interest and the performance of our contracts with third parties as our legal basis for processing your personal information.

We may disclose aggregated or other information about our users that does not contain identifying information to third parties, without restriction. In addition, we may disclose personal information that we collect from you or your access to, registration to use, or use of CheqrPay:

  • to fulfill the purpose for which you provide it;
  • to our subsidiaries and affiliates;
  • to contractors, our third party service providers, and other third parties who support our business and are contractually bound to maintain the confidentiality of the personal information and to use it solely for the purpose for which it was disclosed;
  • to third parties to market their products or services to you if you have consented to or have not opted out of such disclosures;
  • with your consent;
  • to comply with our obligations or enforce our rights with respect to users of CheqrPay;
  • to a buyer or other successor in the event of a merger, divestiture, restructuring,
    reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our users of CheqrPay is among the assets transferred;

  • if we reasonably believe disclosure is necessary or appropriate to protect the rights, property, or safety of our company, our customers, or others;
  • for any other purpose disclosed by us.

 

The business or administrative services provided by third parties include, without limitation, payment processing, file storage, database management, communications services, cloud hosting services, marketing, identity verification services, and other information technology services. We may also disclose your personal information to our professional advisors and agents.

Customers receiving payments from you through CheqrPay are able to access the personal information that you provide us, except for financial information provided directly to Stripe. We disclose your personal information to third parties to assist us in providing the best possible service to our customers. We limit third party access to personal information to the extent reasonably necessary for us to deliver services our customers, or as required by law.

 

6. How Long We Keep Your Information

We will retain your personal information for a reasonable amount of time, as allowed by the law. Thereafter, we will take reasonable steps to destroy or permanently anonymize such information in accordance with applicable laws.

 

7. How We Protect Your Information

We take all reasonable steps to protect your personal information from unauthorized access, modification or disclosure, including misuse, interference, and loss. We secure such information in accordance with industry standards. Although our third party service providers may use encryption to transfer personal information, we cannot guaranty the security of online transactions and electronic exchanges or communication. Users of CheqrPay provide personal information to us at their own risk.

We are not responsible for the privacy or security practices of any third party, including our users, our third party servicers, and any others to whom we disclose personal information in accordance with this Privacy Policy. The collection, use, storage, and disclosure of your personal information by such third parties is subject to their own privacy and security policies.

We may make links available to you to access websites that are not under our control, solely for your convenience.  The owners or operators of such websites maintain their own policies regarding privacy and terms of use, and they are solely responsible for the content of their websites.

We disclaim any responsibility for linked websites that are not under our control.

8. Your Legal Rights

You have the right to request:

  • access to your personal information;
  • correction of your personal information;
  • deletion of your personal information; and

Our users are responsible for providing us with accurate and truthful personal information, and for properly updating such information. We cannot be liable for any information provided to us that is inaccurate, incomplete, or outdated.
